New regulations implementing an EU Directive aim to protect consumers from unfair trading practices
Important new regulations were introduced on Monday 26th May. They replace a number of older statutes that have either been revoked or repealed.
The Consumer Protection from Unfair Trading Regulations 2008 (CPR's) apply to business to consumer transactions and implement a general duty not to trade unfairly.
The new law bans unfair advertising, marketing and other commercial practices used by businesses in their dealings with consumers. In particular, practices considered misleading or aggressive are banned and there is a further list of 31 specifically banned practices. Trading Standards authorities will be responsible for enforcing the new regulations.
