For most people, buying a laptop, the latest television or music system is likely to be a major purchase. As they become increasingly sophisticated there is perhaps an increased likelihood that some function won’t work correctly for as long as you think it ought to.
What are my rights?
The equipment sold by a trader must be
-
as described by the seller
-
be of satisfactory quality (safe, durable, free from minor defects and have suitable appearance and finish. The price you pay will also help determine whether this standard has been reached. It is what a “reasonable” person would expect to receive.)
-
“fit for [the intended or agreed] purpose”.
What you may be entitled to if this standard is not met may well depend on how long you have had the item for. If the fault is just down to fair wear and tear or misuse you will have no claim.
The Trader has told me to contact the manufacturer
The rights set out above are your rights against the trader that sold you the equipment. You have these rights regardless of whether you have a warranty.
You may choose to go to the manufacturer if you wish under any warranty or guarantee that you may have with them, but the trader cannot use this as a way of avoiding dealing with you. If you would rather claim against the trader, you can do so. For more information on warranties and guarantees, visit the Citizens Advice website.
The trader won’t assist me
If you have paid by credit or debit card you may have additional rights if things go wrong under the Consumer Credit Act 1974. Our pages Protection on your credit card will give you more information about this.
In addition, see our pages on Resolving a dispute with a trader which will give you further advice on taking a Small Claims Court action.
Does it make a difference if I didn’t view the equipment before I bought it?
If you bought your item “by distance” such as from the internet, you may also have additional rights, see our page Shopping online.
