Planning Appeals

It is open to an applicant for planning permisson for Minerals and Waste development to submit an appeal to the Secretary of State in the following circumstances:

  • In respect of a refusal of planning permisson by the Council
  • In respect of the failure of the County Council to determine a planning application within the timescale agreed with the applicant provided it is no less than 8 weeks from submission
  • In respect of the imposition of a planning condition which the applicant considers restricts the development to an unacceptable degree

A record of current planning appeals lodged with the Planning Inspectorate is provided on the left hand side. Please note there is no right of appeal in respect of County Council planning applications (i.e. schools, County roads and libraries).

Unauthorised Development

A landowner in receipt of an Enforcement Notice served by the Council can also appeal to the Secretary of State on a number of grounds laid out in legislation. Details of these can be provided by the Council.
