The standard CON29 search does not cover public rights of way. Question CON29O is an optional question for which an additional fee is payable (see ‘Charges’ at the link above). This will tell you if there is an existing right of way recorded on the Definitive Map & Statement (DM&S). Bear in mind that the DM&S is the minimum record of rights that exist and is without prejudice to any other rights that may exist but are not recorded. The maxim ‘buyer beware’ applies. It is recommended that question CON29O is asked when any search is undertaken.
The answer to CON29O will not tell you the width or boundaries of the path; whether there is a claim for a right of way over the land underway; whether there is a possible ‘lost highway’; whether an existing route is being changed in any way; or whether there are any other issues you might wish to be aware of such as permissive paths.
