Following recent media coverage, the County Returning Officer, Dr Stephen Moir, who is also the Chief Executive of Cambridgeshire County Council has today issued a statement to clarify the position of this County Council seat.
“Unfortunately, incorrect information has been circulated on social media to indicate that a By Election for the Roman Bank and Peckover Division county council seat has been called. This statement is therefore being provided to ensure that a clear, factual and correct position is shared with residents and other interested groups and individuals.
"The Roman Bank and Peckover Electoral Division is currently occupied by Councillor Andy Osborn. Mr Osborn is currently an unaligned, independent County Councillor and is suspended from the duties of his office, following recent court proceedings and the judgement issued.
"In accordance with the provisions of the Representation of the People Act 1983, Mr Osborn remains entitled to hold this council seat until any appeal against the judgement of the Court has been lodged and discharged. That means that no vacancy for the Division can be declared until, at the earliest, the period in which an appeal can be lodged has first expired. Consequently, the earliest date for the seat to be declared vacant is 6 May 2026, should Mr Osborn choose not to appeal against the judgement of the Court. Should, however, an appeal be lodged, then the seat will not become vacant until 15 July 2026, except where the appeal is discharged earlier than this date.
"Therefore, the seat is not currently vacant and no By Election can be called at present.”
