Cambridgeshire County Council has a duty to keep and maintain a register of all landowner deposits made under the Highways Act 1980 and the Commons Act 2006.

If evidence can be provided that a route or an area of land has been open to and used by the public for 20 years without challenge by the landowner, a claim could be submitted to the council for the land to be recorded as a public right of way or a town or village green.

Landowners can protect their land from such claims by depositing certain documents with the council under section 31(6) of the Highways Act and section 15A(1) of the Commons Act 2006.

If correctly lodged and maintained the deposit of these documents can provide evidence that the landowner did not intend to dedicate a public right of way or town or village green on their land.
