When can I claim?

Who is responsible for which roads?
As Highway Authority, the Cambridgeshire County Council is responsible for the highway network across the county. We must maintain the network at a suitable standard for their status and use, this is required by Section 41 of the Highways Act.
The County Council has a system to inspect roads and footways so we can meet our obligations, using a risk based approached.
Each road and footway is the subject of inspection. The frequency of inspection depends on their classification or status. When a defect or fault is found, any repairs are done within set times. Defects reported by members of the public are treated in the same way.
National Highways (formerly Highways England) is responsible for the maintenance of trunk roads and motorways, not the County Council.
Claim guidance
A claim for damages arising from an incident on the highway is a legal claim. It will not be treated as a customer service complaint.

We consider your claim against our legal duties under the Highways Act and the conduct of your claim will be in accordance with the Civil Procedure Rules and in line with the relevant Pre-Action Protocols (justice.gov.uk).
Claim form
Please complete the below Public Liability Claim Form. As a claimant you must supply full details of the incident. This will include:
- the date and time
- a description of exactly where the incident occurred
- photographs of the incident site if available
- details of damage or injury sustained.
